1. General provisions
These Terms set out the rules for using KiwiHub, which consists of the web dashboard at kiwi-hub.pl (the “Dashboard”) and the Discord bot “KiwiBot” (the “Bot”), together the “Service”.
The Service is provided by the owner of KiwiHub (the “Provider”, “we”). Contact: contact@kiwi-hub.pl. These Terms are terms of service within the meaning of the Polish Act of 18 July 2002 on the Provision of Electronic Services.
By using the Service, you accept these Terms. If you do not agree with them, do not use the Service.
2. Definitions
- User: a person who logs in to the Dashboard or uses the Bot.
- Server administrator: a User who has owner, administrator or “Manage Server” permissions on a Discord server and configures the Bot there.
- Server member: a person who belongs to a Discord server where the Bot runs.
- Access code: a one-time code issued by the Provider that unlocks selected Dashboard features.
3. Scope of services
As part of the Service, we provide free of charge:
- a Discord Bot with modules for moderation, automation, welcome messages, levels, economy, giveaways, notifications and other features, configured in the Dashboard,
- a Dashboard for managing the Bot on servers where you have the required permissions,
- tools for accounts on third-party services (Twitch, Kick, Steam, Riot Games, GOG, Amazon), available by invitation only, after entering an Access code.
The set of features may change. We may add, change or turn off features, in particular when changes on Discord or other services the Service connects to require it.
4. Technical requirements
- a device with internet access and an up-to-date browser (Chrome, Firefox, Edge, Safari or similar) with JavaScript and cookies enabled,
- an active Discord account that meets Discord's requirements,
- to configure the Bot: administrator permissions on a Discord server and the Bot added to that server,
- for invite-only tools: your own account on the given service (Twitch, Kick, Steam, Riot Games, GOG, Amazon) and an Access code.
5. Account and access
Your Dashboard account is created automatically the first time you log in with Discord. The service agreement is concluded at your first login and lasts until your account is deleted.
- We may make the Dashboard, or part of it, available only to invited people (“invite-only” mode).
- Access codes are personal. You may not sell or publish them.
- You are responsible for the security of your Discord account and of the accounts you add to the Dashboard.
- You can delete your account yourself in the Dashboard (Settings → Privacy and data → Delete account) or by asking us by email. Deleting your account ends the agreement.
6. Rules of use
By using the Service, you agree not to:
- provide or spread through the Bot any content that is unlawful, offensive, hateful or infringes the rights of others,
- use the Bot for spam, fraud, phishing or harassing other users,
- try to access other people's servers, accounts or data, or bypass the Service's security,
- overload or attack the Service, or scrape data from it in a way that disrupts its operation,
- violate Discord's Terms of Service and Community Guidelines or the rules of other services the Service connects to.
A Server administrator is responsible for how the Bot is configured on their server, for the content the Bot publishes based on their settings, and for informing Server members about the features that are turned on.
7. Third-party services
The Service relies on Discord and other third-party platforms. We are not affiliated with them and are not responsible for how they work, their downtime or changes to their rules.
Invite-only tools perform actions on your account on a third-party service (Twitch, Kick, Steam, Riot Games, GOG, Amazon). You use them at your own risk and decide for yourself whether this complies with that service's terms. We are not responsible for restrictions, bans or loss of points or rewards on that account that may result.
8. Content and intellectual property
Content you create in the Dashboard (messages, embeds, images, configurations) remains yours. You grant us a non-exclusive, free permission to store it and have the Bot publish it to the extent needed for the Service to work. This permission ends when you delete the content.
You may not upload content you do not have the rights to. The KiwiHub name, logo, the look of the Dashboard and the Service's code belong to the Provider. The names and marks of Discord, Twitch, Kick, Steam and other services belong to their owners and are used only to indicate integrations.
9. Availability and liability
The Service is provided free of charge and “as is”. We work to keep it stable and secure, but we do not guarantee uninterrupted availability. Maintenance breaks, updates and outages may occur.
To the extent permitted by law, we are not liable for damage resulting from Service downtime, loss of data on a Discord server, actions of other users or the operation of third-party services. This limitation does not apply to damage caused intentionally or to rights that cannot be excluded for consumers.
10. Suspension and account removal
If you violate these Terms or the law, we may restrict your access to features, block your account or remove the Bot from a server where it is used in breach of these Terms. Where possible, we will tell you why. If you think a block is unjustified, write to contact@kiwi-hub.pl.
11. Complaints
Send complaints about how the Service works to contact@kiwi-hub.pl. Describe the problem and include details that let us identify you (e.g. your Discord name or ID). We will review the complaint within 14 days and reply to the address it came from.
If you are a consumer, you may use out-of-court dispute resolution, for example help from a municipal or district consumer ombudsman in Poland.
12. Personal data
How we process personal data is described in our Privacy Policy.
13. Changes to the Terms and final provisions
We may change these Terms for important reasons, e.g. when Service features, laws, or the rules of Discord or other services the Service connects to change. We will announce changes in the Dashboard at least 7 days before they take effect. If you do not accept the changes, you can delete your account.
Matters not covered by these Terms are governed by Polish law. These Terms do not limit consumer rights under mandatory provisions of law. The current version of the Terms is available at kiwi-hub.pl/en/terms.
This is an English translation provided for convenience. If the English and Polish versions differ, the Polish version prevails.
